The ESG disclosure movement is expanding as businesses choose to disclose this information voluntarily and governments impose disclosure requirements. Corporations must now navigate the evolving and varied disclosure and labeling requirements they are subjected to across multiple jurisdictions. As ESG disclosure expands, so do the litigation risks. This panel addresses the laws and regulations that cover ESG disclosure, as well as consumer and securities greenwashing litigation, especially in light of recent decisions about regulatory authority from the Supreme Court.
